Yes, copyright is normally a civil matter. (I.e. not criminal.) I really wouldn't describe either shard as illegal, though of course, Cyan is free to bring a lawsuit against admins. Whether it would succeed or not would be a tough question even for lawyers, I think. In any event, I would say that you don't have to worry about anything illegal on either shard.

Like most of what goes on here, this is still a gray area that could easily be summed up with the above-mentioned sentence.

Cyan knows we exist and assuredly knows what we're doing. As long as nobody is a getting express-mailed "Cease and Desist Order", then it's a back-handed form of support. As I said in another thread, Rand himself has praised the work of Age Builders long before MO:UL or OpenUru was ever a possibility, so I think a lot of naysayers can be silenced just by pointing to some quotes in the interview at the back of the Prima Guide for Myst V.
