Some of those servers are, yes. The ones that are openly distributing or running on liscensed blizzard software, or are using it for malicious means, i.e. virus laiden updates, are being shut down. That being said, the majority are receiving no flak from Blizzard at all. The reason being is that the server itself is being emulated. It is in no way IP of Bliz, because it has been rebuilt from the ground up by other programmers. If I am not mistaken, Alcugs falls into the same category, unless the people who wrote it managed to get ahold of some Cyan source code. (Highly unlikely)
The thing is, all of the Cyan maps come with the software that you use to play on alcugs. There for, those hosting the server do not violate any copywrite laws. Even if Cyan did want to shut the server down, there is nothing they could do, legally to make it so. (Though I am sure any host would gladly take the server down, should Cyan indeed ask.)
The major issue that I see with Alcugs is that you need Cyan software that is no longer being distributed. The biggest benefits to running such a server is to maintain intrest of those who have followed the series for so long, and to attract new persons, which reinforces the first point. If running an Alcugs server, we can't bring in new people, which cuts off a vital aspect of the survivability of such a project. Still, something is better than nothing, in my opinion.
