It should conform to the bottom of the body of water.

Couldn't you add an edge ring of vertices, around the ones you've got and bring them up to just under floor level (inside the wall for the upper pool), outside of the boundries of the pool? That way you would extend the bounding box upwards, so that the waveset isn't culled, when it shouldn't be, but the depth of the part that counts would still be constant.

Actually, you could probably make that waveset mesh a single rectangle - no need for it to follow the pool edges at all.. :7

I have been thinking about making it a rectangle. I had some plans (and still have) for the space below the top floor/platform and I didn't want the waveset to get in the way. Besides this felt cleaner.

What I could do is extrude the outer ring and bring it straight up. I have another iregular waveset on the topfloor below the rock and fountain. I should probably be safe and do the same for the one up there too.

But... wouldn't that add overhead to the flattening of the surface?

Yes, that did it. I stretched the sides up to waterlevel and the waveset stopped disappearing. It even looks beter now! Thxn all!
