one question I was reading up on the site, apparently its OEM software but where it sez

OEM software does not come in a retail box, doesn't include printed manuals, cannot be transferred (even if the original computer breaks), and is not eligible for free technical support from the manufacturer

does this mean if I upgrade my hard drive I can not put this program on it

This is typical of OEM software. Upgrading the hard drive should not count unless the software uses the disk ID code for activation. Buying a new computer counts. Replacing the CPU chip or mainboard would probably break the license agreement as well. If the software bonds with the CPUID hard-coded in the processor chip (which I don't know if it does), it would make it unable to transfer and reactivate. Most really high-end software like this I've ever dealt with had some mechanism to keep it from being able to migrate to any other system or multiple systems.

Windows OEM operating systems used to keep track of every change of HW in the box... change too much and you would need to call Microsoft and beg for a new activation code. I believe they loosened this policy a bit for the last few releases.

I knew a site that kept popping up under different names, usually it had something with "soft" in its name. So I can't be sure if this is the site I knew but it sure looks like it.
They sold the same pirated stuff you can find on warez and torrent sites for free. The only difference was that they checked it for malware and simplified the installation process (installing pirated software is often rocket science for regular users).

Remember: If it sounds too good to be true it probably is.

Edit: If you scroll down you'll see that they have 3DS Max 2011 and 2012 for he same price. How likely is that?

This site was just created a couple of months ago (19 Mar). It is located in Denmark. Enough people have checked up on the site to cause Google to actually capture some of the queries people are running against it.

I would dismiss it as too risky to do business with.
